1.0 Terms and Conditions
Please read this page carefully. If you do not accept the Terms and Conditions stated here, do not use this website and service. You choose to accept these Terms and Conditions and be entirely bound to this agreement by using this website. Healthcare Employment Partners Inc. (the "HCEP" and “COMPANY”) may revise these Terms and Conditions at any time by updating this posting. The terms "You" and "User" (the people accessing and using this website) should periodically review HCEP’s website (the "WEBSITE") for the Terms and Conditions as you are obligated to follow them.
In using the Site, you represent and agree that you have read and agree to be bound by the Terms and:
(i) Will comply with U.S. law regarding the transmission of any data obtained from the WEBSITE in accordance with the Terms
(ii) Shall not use the WEBSITE for illegal purposes
(iii) Shall not use the WEBSITE or content for any commercial purposes
(iv) Shall not interfere with or disrupt networks connected to the WEBSITE.
2.0 HCEP Specific Prohibited Uses
Individuals seeking employment and career information and employers seeking employees may use the Website only for lawful purposes. The COMPANY specifically prohibits any use of the Website, and all users agree not to use the Website, for any of the following:
(a) Posting any incomplete, false or inaccurate biographical information or information which is not your own (living individual seeking employment on a full-time or part-time basis on his or her own behalf)
(b) Posting any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an upfront or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents
(c) Deleting or revising any material posted by any other person or entity
(d) Transmitting, distributing, storing, or destroying material
(e) Infringing the copyright, trademark, trade secret, or other intellectual property rights of others or violating the privacy, publicity, or other personal rights of others
(f) Disclosing or sharing your password with any third parties or using your password for any unauthorized purpose
(g) Doing anything on the site that is defamatory, obscene, threatening, abusive, or hateful.
3.0 Website Security RulesUsers are prohibited from violating or attempting to violate the security of the Website, including, without limitation:
(a) Accessing data not intended for such user or logging into a server or account the user is not authorized to access
(b) Attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization
(c) Attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Website, overloading, "flooding", "spamming", "mailbombing", or "crashing"
(d) Sending unsolicited e-mail, including promotions and/or advertising of products or services
(e) Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
Violations of system or network security may result in civil or criminal liability. The COMPANY will investigate such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
PLEASE NOTE THAT, IN ADDITION AND WITHOUT PREJUDICE TO THE RIGHTS OF ART AT LAW TO RESTRICT THE TYPES OF USE REFERRED TO ABOVE, THESE RESTRICTIONS ARE ALSO CONTRACTUAL IN NATURE AND BIND ALL USERS OF THE SITE.
4.0 Use of Website MaterialHCEP authorizes you to view and access the content available on or from the "Website" solely for your personal, noncommercial use. The contents of this Website, such as graphics, text, images, logos, button icons, software, and other material are protected under United States and foreign copyright, trademark, and other laws. All Website Material is the property of the COMPANY or its content suppliers or clients. Unauthorized use of the Website Material may violate copyright, trademark, and other laws. You must retain all copyright, trademark, service-mark and other proprietary notices contained in the original Website Material on any copy you make of the Website Material. You may not sell or modify the Website Material or reproduce, display, publicly perform, distribute, or otherwise use the Website Material in any way for any public or commercial purpose. The use of the Website Material on any other web site or in a networked computer environment for any purpose is prohibited. You shall not derive or attempt to derive the source code, source files, or structure of all or any portion of the Materials by reverse engineering, disassembly or any other means. You shall not copy or adapt the HTML code the COMPANY creates to generate any Website Material or the pages making up HCEP. You may not rent, disclose, publish, sell, assign, lease, sublicense, market, or transfer the Materials or use them in any manner not expressly authorized by this Agreement. We will terminate the accounts of any account holders, and block access to our Website of any users who infringe of the copyrights, or other intellectual property rights, of others. We reserve the right to take these actions at any time, at our sole discretion, with or without notice, and without any liability to the account holder who is terminated or to the user whose access is blocked.
5.0 Content MonitoringAs a matter of policy, HCEP does not prescreen or monitor communications in advance and is not responsible for screening and monitoring material posted by users. We have the right, but not the responsibility, to remove any information or dialog it deems in its sole discretion to be harmful, offensive, or otherwise in violation of any rules HCEP has in place at the time.
6.1 Use of Secure Area and PasswordOnly registered users are allowed to use any password-protected area of the Website. This password cannot be distributed to others, and the registered user is responsible for any and all damages to HCEP resulting from the distribution of his or her password. It is the registered user's responsibility to maintain the confidentiality of the information and password. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify HCEP of any unauthorized use of your registration or password.
6.2 Accurate and Truthful InformationYou certify that the information you enter into the System is truthful and accurate to the best of your knowledge. You agree to not post any material or links to material that is libelous, defamatory, false, obscene, violent, abusive, threatening, harassing, prejudicial, or is otherwise in violation of the law. You agree to maintain the accuracy of the information you submit to the System to the best of your ability and to update (modify) and/or remove any information that, to the best of your knowledge, has become obsolete, outdated, or inaccurate. You may only submit content for which you have the copyright or other specific permission to distribute electronically. You may not violate or infringe on the rights of third parties including copyright, trademark, trade secret, privacy, or proprietary rights. You grant us rights to what you submit. You agree that HCEP may choose to modify, edit and/or remove any information that it, in its sole discretion, deems inappropriate for its System at any time and without prior or subsequent notice.
6.3 User SubmissionsYou acknowledge and agree that you are solely responsible for the form, content and accuracy of any or material placed by you on the Website. Employers are solely responsible for their postings on the Website. As a user, you are responsible for your own communications and are responsible for the consequences of their posting. HCEP does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk. HCEP acts as a passive conduit for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not conform to these Terms and Conditions, HCEP may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. HCEP has no liability or responsibility to users for performance or nonperformance of such activities. HCEP reserves the right to expel users and prevent their further access to the Web Site for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal, or disruptive. HCEP may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for HCEP or may cause HCEP to lose (in whole or in part) the services of its ISPs or other suppliers.
THE COMPANY DOES NOT WARRANT THAT THE WEBSITE WILL OPERATE ERROR-FREE OR THAT THE WEBSITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE WEBSITE OR THE MATERIAL RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS.
THE WEBSITE AND MATERIAL ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE COMPANIES, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE COMPANIES MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE MATERIAL, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.
7.0 No LiabilityHCEP is only a venue for employers to post job opportunities and interact with candidates, and for candidates to post their profiles and/or resumes for the purpose of evaluating job opportunities for themselves. HCEP does not screen or censor the listings offered, also the COMPANY is not involved in the actual transaction between employers and candidates. Thus, the COMPANY has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Website and/or HCEP. The Companies do not and cannot confirm that users are who they claim to be because user authentication is difficult on the Internet. Also, we do not and cannot be involved in user-to-user dealings or control the behavior of participants on HCEP, in the event that you have a dispute with one or more users, you release the COMPANY (and our agents and employees) from claims, demands, and damages (actual and consequential, direct, and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." We are under no legal obligation to, and generally do not, control the information provided by other users that is made available through the Website. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that you will use caution and common sense when using this Website.
Employers are solely responsible for their postings on HCEP. HCEP is not to be considered to be an employer with respect to your use of HCEP and the COMPANY shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on HCEP.
